Terms of Service

1. Agreement to these Terms

By downloading, installing, or using Axis Echo (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms form a legal agreement between you and Axis Echo, operated by Axis Echo, registered in the United Kingdom. References to "we", "us", and "our" mean Axis Echo.

2. Eligibility

You must be at least 13 years old to use Axis Echo. By using the App you confirm that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

To use Axis Echo you must create an account. You are responsible for keeping your login credentials secure and for all activity that takes place under your account. Notify us immediately at axisechoapp@gmail.com if you believe your account has been compromised.

You must provide accurate information when creating your account and keep it up to date. You may not create accounts on behalf of others without their permission.

4. Subscriptions and Payments

Axis Echo offers a free tier and optional paid subscriptions (Echo Pro and Echo PT). All subscriptions are purchased and managed through the Apple App Store using your Apple ID. Payments are charged to your Apple ID at confirmation of purchase.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period - you retain access until then.

Refunds are handled by Apple and subject to Apple's standard refund policy, available at reportaproblem.apple.com. We do not process refunds directly.

We reserve the right to change subscription prices. We will give reasonable notice of any price change before it takes effect.

5. Acceptable Use

You agree not to use Axis Echo to:

• Violate any applicable law or regulation
• Impersonate another person or create a misleading username
• Harass, abuse, or harm other users
• Attempt to gain unauthorised access to any part of the App or its infrastructure
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the App
• Use automated means (bots, scrapers, scripts) to access or interact with the App
• Upload or share content that is unlawful, obscene, defamatory, or infringes third-party rights
• Manipulate leaderboard scores or competitive features by artificial or fraudulent means

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

6. User Content

You retain ownership of any content you submit to Axis Echo (including workout data, photos, usernames, and profile information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, display, and process that content solely to provide and improve the App.

You are responsible for any content you submit. Do not upload content you do not have the right to share. Workout photos shared to Squad are automatically deleted after 48 hours.

We may remove content that violates these Terms or our community standards, without notice.

7. Health and Fitness Disclaimer

Before starting any new exercise programme, particularly if you have a pre-existing health condition, injury, or are returning from illness, consult a qualified healthcare or medical professional. AI suggestions within the App are based on your logged data and are not a substitute for professional medical or physiotherapy advice.

You exercise and use any advice or suggestions at your own risk. We accept no liability for any injury, illness, or health consequence arising from your use of the App or any AI-generated content within it.

8. Third-Party Services

Axis Echo uses the following third-party services to operate:

• Apple App Store - subscription management and payment processing
• Supabase - database and authentication, hosted in the United Kingdom (AWS eu-west-2, London)
• PostHog - anonymous usage analytics, hosted on EU servers

These services have their own terms of service and privacy policies. Your use of Axis Echo is also subject to those terms where applicable.

9. Intellectual Property

All content, design, code, branding, and features within Axis Echo (excluding user-submitted content) are owned by or licensed to Axis Echo. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our prior written permission.

"Axis Echo", "Echo Pro", "Echo PT", "Arena", "Pursuits", "Academy", "Squad", "T-Paths", and "Axi" are used as product names by Axis Echo. Unauthorised use of these names is not permitted.

10. Disclaimers

Axis Echo is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content, scoring data, leaderboard positions, or coaching suggestions within the App.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Axis Echo and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the App.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or £10, whichever is greater.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. We will notify you of material changes through the App or by email where reasonably possible. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Termination

You may stop using Axis Echo at any time and delete your account from within the App (Profile > Settings > Delete Account).

We may suspend or terminate your access to the App at any time if you breach these Terms, if we are required to do so by law, or if we decide to discontinue the App. On termination, your right to use the App ceases immediately.

Sections 6, 7, 9, 10, 11, and 14 survive termination.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer in another jurisdiction with rights that cannot be waived by contract.
